Members are advised that following last votes, the House will continue debating amendments to H.R. 2354 into the evening.
H.Res. 347 - Rule providing for consideration of H.R. 2018 – Clean Water Cooperative Federalism Act of 2011 (Rep. Mica - Transportation and Infrastructure) (One hour of debate) The Rules committee has recommended a structured Rule that provides one hour of general debate equally divided between the Chair and Ranking Member of the Committee on Transportation and Infrastructure. The Rule makes in order 10 amendments, each debatable for 10 minutes, and allows one motion to recommit, with or without instructions.
The Rules committee rejected a motion by Mr. McGovern to consider the bill under an open Rule, and also did not allow an amendment, offered by Ms. Castor, which would have required the federal government to route at least 80 percent of fines collected from the April 2010 Deepwater Horizon spill to activities that address the impact of the Gulf oil spill.
H.R. 2018 – Clean Water Cooperative Federalism Act of 2011 (Rep. Mica - Transportation and Infrastructure) (One hour of general debate) This bill amends existing water pollution laws to prohibit the EPA from issuing a new or revised water quality standard, unless the state agrees that action is necessary. H.R. 2018 prevents the EPA from taking action to revise outdated state water quality standards and would hinder their ability to protect certain bodies of water.
The Rule provides for 10 amendments which are debatable for 10 minutes each, equally divided between the offeror and an opponent. The amendments are listed below:
Jackson Lee Amendment #7. Would strike all after the enacting clause
Jackson Lee Amendment #6. Would strike section 2 of the bill
Capito Amendment. Relating to EPA analysis of certain covered actions on unemployment levels
Hanabusa Amendment. Relating to a study of toxic chemicals and metals in waters regulated by states
Polis Amendment. Clarifies that the bill does not limit EPA's authority to address permit holders that have a history of Clean Water Act violations
Connolly Amendment. Relating to making federal funding align with the scope of federal clean water regulations
Deutch Amendment. Would exempt the everglades from the provisions in the bill
Cohen Amendment. Relating to not limiting EPA’s ability to regulate when a pipeline crosses a streambed
Markey/DeFazio Amendment. Clarifies that the bill does not limit EPA’s ability to regulate waters to reduce flooding risks, protect fish and wildlife and preserve coastal recreation
Carnahan Amendment. Clarifies that the bill does not limit EPA’s ability to regulate waters to reduce flooding risks in areas that have received Presidential Disaster Declarations due to flooding
Continue Consideration of H.R. 2354 – Energy and Water Appropriations Act, 2012 (Rep. Frelinghuysen – Appropriations) H.R. 2354 appropriates approximately $30.6 billion for the Department of Energy and related agencies, related programs, and federal water projects. The funding level is $5.9 billion below the President's FY12 request and $1 billion below the enacted level for 2011.
The House completed general debate on 7/8. On Monday evening, the House completed reading through page 24 of the bill. The House is expected to continue reading through the bill and debating further amendments on H.R. 2354 tonight, following last votes. That is a change to the previously announced schedule.
