H.Res. 431 - Rule providing for consideration of H.R. 2273 - Coal Residuals Reuse and Management Act (Rep. McKinley - Energy and Commerce) (one hour of debate) The Rules committee has recommended a structured Rule that allows six amendments to be considered with each amendment debatable for 10 minutes equally divided between the offeror and an opponent. It provides one hour of general debate equally divided between the Chair and Ranking Member of the Committee on Energy and Commerce. The structured Rule allows one motion to recommit, with or without instructions. It also waives all points of order against consideration of the bill.
 
The Rules committee rejected a motion to consider the bill under an open Rule. It also rejected a motion by Mr. Hastings (FL), which would have made numerous amendments in order, including an amendment offered by Mr. Ellison, which would nullify the bill if it authorizes appropriations without a corresponding offset. The bill, as currently drafted, violates the legislative protocols set forth by the GOP Majority relating to offsetting authorizations of appropriations.
 
H.R. 2273 - Coal Residuals Reuse and Management Act (Rep. McKinley - Energy and Commerce) H.R. 2273 would create a State-based permit program for the disposal of waste generated from coal combustion. The bill creates a federal program for the recognition of state-level permitting programs for the storage of coal combustion waste. The bill also limits the authority of the EPA to issue regulations or enforce standards regarding coal combustion waste, unless states fail to implement their own permit program.
 
The Congressional Budget Office estimates the bill would cost the federal government $2 million over the FY 2012 to FY 2016 period, subject to the availability of appropriated funds. There is currently no offsetting reduction in programmatic authorization in the legislation.
 
H.Res. 431 makes in order the following 6 amendments, each debatable for 10 minutes:
 
Shimkus Manager’s Amendment.  Relating to technical changes to the legislation, including clarifications on state notifications and certification requirements to the EPA.
Waxman Amendment. Would require state coal combustion waste programs to meet a standard of protection for human health and the environment.
Carney Amendment. Would establish a 10 year timeframe in which existing coal combustion waste disposal sites must meet design and monitoring requirements under the bill.
Markey Amendment. Would require the states to notify the public and EPA and offer the opportunity to comment before a state may waive any of the minimum criteria in the bill.
Rush Amendment. Retains federal enforcement authority in the event that a state coal combustion waste program violates the standards in the bill.
Jackson Lee Amendment. Requires the EPA Administrator to report to Congress within 5 years on the long-term impacts of state coal combustion residuals permit programs on human health and the environment.
