H.Res. 500 - Rule providing for consideration of the Conference Report and H.R. 3672 , as well as H.Con.Res. 94 –
The Rule provides for consideration of three separate pieces of legislation.
For the Conference Report, the Rules committee has recommended a closed Rule that provides 60 minutes of general debate equally divided between the Chair and Ranking Member of the Committee on Appropriations, as well as a Member opposed to the Conference Report. The Rule allows no amendments and one motion to recommit. It also waives all points of order against the legislation.
For H.R. 3672, the Rule would provide 60 minutes of general debate equally divided between the Chair and Ranking Member of the Committee on Appropriations. The Rule allows no amendments and one motion to recommit. It also waives all points of order against the legislation.
For H.Con.Res. 94, the Rule provides 20 minutes of debate equally divided between the Chair and Ranking Member of the Committee on Appropriations. The rule contains a provision which requires the clerk to hold H.R. 3672 in the House until the Senate takes a vote on adoption of H.Con.Res. 94.
The Rule also contains Martial law authority for any bill related to the payroll tax extension, and/or appropriations through December 31st, and allows suspension authority for any continuing resolution that is brought up today.
Conference Report to H.R. 2055 – Consolidated Appropriations Act (Rep. Rogers (KY – Appropriations)
The Conference Report contains FY 2012 funding for federal agencies under the remaining nine Appropriations bills, including: Defense, Energy and Water, Financial Services, Homeland Security, Interior/Environment, Labor/Health and Human Services/Education, the Legislative Branch, Military Construction/Veterans Affairs, and State/Foreign Operations.
This legislation upholds the overall regular (base) discretionary level of $1.043 trillion as agreed to in the Budget Control Act (BCA). Alone, this nine-bill legislation includes a total of $915 billion in regular security and non-security discretionary funding – $6 billion below last year’s (FY 2011) level for these same agencies.
While this Conference Report is far from perfect, the most egregious policy riders insisted upon by Republican Conferees have been stripped from the bill. Among these, controversial language related to Cuba and the removal of language clarifying the Department of Treasury’s “cash in advance” rule regarding certain U.S. exports to Cuba have been removed. The final version of the Conference Report also allows the Commodity Futures Trading Commission (CFTC) to transfer $10 million in funding between the agency’s Information Technology account and its Salaries and Expenses account to address a shortfall in personnel funding. It does include a ban on enforcing light bulb energy efficiency standards set forth in the Energy Policy and Conservation Act.
All House Democratic Conferees signed the Conference Report, which would provide funding for the remaining government agencies at the levels agreed to in the Budget Control Act. It would keep government open and running for the remainder of this fiscal year. Members are urged to vote YES

H.R. 3672 - Disaster Relief Appropriations Act (Rep. Rogers (KY) – Appropriations)
This legislation provides $8.1 billion of disaster aid and recovery assistance for disaster emergencies. It includes $6.4 billion for the FEMA Disaster Relief Fund. This includes funding for fire assistance, emergency declarations, major disasters, surge operations, and disaster readiness support. It also provides $1.7 billion in funding for disaster recovery assistance through the Army Corps of Engineers.

H.Con.Res. 94 - Directing the Clerk of the House of Representatives to make corrections in the enrollment of H.R. 3671 (Rep. Rogers (KY) – Appropriations)
This concurrent resolution would direct the Clerk of the House of Representatives to make corrections in the enrollment in H.R. 3672 – the disaster relief legislation. This would amend the H.R. 3672 to offset the $8.1 billion disaster funding, which has historically been categorized as an emergency. This offset would add an additional 1.83% across-the-board cut to all FY 2012 base discretionary spending, but exempt the Department of Defense, Military Construction, and Veterans Affairs from that across-the-board cut.
The GOP Leadership has not announced the legislative schedule for this weekend or next week.
